Terms of Service Last update 3/30/03   General Disclaimer Wizards Casino is not responsible for use of service that does not fully comply with our terms of service and cannot be held accountable for the unauthorized actions of our customers.   A. Service Wizards Casino offers a free wireless internet connection (Specs in section F) to any qualifying (Meeting all the requirements of section B) customer as long as they agree to adhere to our acceptable use policies (Sections C, D) and accept our limitations and liabilities (Section E). We reserve the right to amend this TOS and/or discontinue service at any time. Use of this service denotes acceptance of all of the terms of this document.   B. Qualifications We currently provide one PC for our customers to use to browse on our wireless service. You are free to bring in your own Wi-Fi enabled laptop or other wireless device to connect to our service. This service is for our paying customers. You may use this service only in our restaurant, bar, or pull-tab area. You may not use this service outside of our facility. We do not allow the use of any wireless device anywhere in our Casino area at any time. Persons using the service without qualifying may be barred from the property and/or your MAC address may be banned from our service.   C. Acceptable use You may not use this service for downloading/uploading or otherwise distributing or viewing of any illegal or copyrighted materials. Further, you may not use this service as a host for P2P (Peer to peer) applications or as a server such as for web hosting or FTP serving. We currently allow for downloading legal content as long as you only download one file at a time and do not tie up a significant amount of bandwidth. You may use this service to play games as long as you do not tie up a significant amount of bandwidth, provided that the game is not offensive in content as provided under section D. Due to bandwidth restrictions, we request that you do not use this service for voice, video communications, video streams, or other high bandwidth traffic unless there are no other users or no objections from other users at that time. We reserve the right to limit the usage of anyone that abuses the bandwidth. The decision of management is final with respect to bandwidth allocation.   D. Objectionable Material You may not view, distribute, or promote objectionable material anywhere on the property of Wizards Casino or on our network including pornographic material, hate related sites/material, pictures/games with gore or violence, items of an illegal nature, or anything else that our other customers or employees may find offensive. Management will have the final say as to what will be allowed. You may not use our service to conduct illegal activities such as spreading vicious code (virus, worms, etc), attacking other users or internet sites, or promoting illegal activities of any kind. We reserve the right to log your information and turn it over to the proper authorities in the event that we discover illegal use of our service.   E. Limitations and Liabilities This service is provided as is. We do not guarantee its availability or access speed. We are not responsible for damages due to service unavailability. We provide only basic security (Section F). Use at your own risk. We encourage all users to protect their devices with firewall, and/or other security software/hardware. More information about security may be found in our FAQ section. We are not responsible for any losses that may occur due to attacks or hacking by other users. Power outlets are available at some tables. These outlets are provided as a courtesy to our customers and are provided "as is". They are not protected by surge suppressors. We advise that you provide your own protection. We are not responsible for any damage to data or equipment as a result from surges or any other anomaly from our power outlets.   F. Specifications We are providing an ADSL connection with 650k down, and 256k up speed to our qualifying customers (as defined in section B). This is a dedicated line just for our customers and is not used internally. Access is provided by way of a dual Wi-Fi compliant 802.11a and 802.11b access point. Up to 64 simultaneous users may be on at the same time. The DSL modem uses DHCP and NAT to assign IP in the 10.0.0.x space. NAT (Network address translation) may prohibit some games and applications from functioning properly. Check with the programs help system if you are having problems connecting due to NAT. There are no filters or other blockers on this line. As of this writting, we will not be using WEP or other security protocols on this network. You should use personal firewall software and other security measures to protect yourself. Read the FAQ page for more information about security.
